Terms and Conditions
Effective Date: October 29, 2026
These Terms and Conditions (“Terms”) govern your access to and use of AccuGuard.com and any related pages or subdomains we operate (collectively, the “Site”), operated by AccuGuard Franchising, LLC (“AccuGuard,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
These Terms supersede and replace in their entirety any prior terms of use or terms and conditions published on or in connection with the Site as of the Effective Date above.
1. Eligibility
You must be at least 18 years old to submit a service request through the Site. By using the Site, you represent that you meet this requirement and that the information you provide is accurate, current, and complete.
2. Independently Owned and Operated Local Offices
AccuGuard environmental testing services are performed by independently owned and operated franchise businesses (“Local Offices”), not by AccuGuard Franchising, LLC. Each Local Office is solely responsible for the services it provides, including scheduling, pricing, staffing, licensing, testing, results, reports, and customer communications. AccuGuard is not a party to any agreement between you and a Local Office and is not responsible for the acts or omissions of any Local Office.
3. Service Requests
Submitting a service request through the Site is a request to be contacted. It does not create a contract, guarantee service, or confirm an appointment, price, or availability. Services, service areas, and pricing vary by Local Office. Any services you purchase will be governed by the separate agreement, estimate, or work authorization you enter into with the Local Office.
4. Informational Content Only
Content on the Site, including descriptions of asbestos, lead, mold, and fire and smoke testing, is provided for general informational purposes only. It is not professional, medical, legal, engineering, or remediation advice and is not a substitute for an on-site inspection or laboratory analysis. Do not rely on Site content to make health or safety decisions. If you believe you face an immediate health or safety hazard, contact emergency services or the appropriate authorities.
5. Communications
By submitting a form, you agree that AccuGuard and the Local Office serving your area may contact you by email, telephone, or text message at the contact information you provide to respond to your request and follow up about AccuGuard services, as described in our Privacy Policy. Where the law requires separate consent for automated or marketing calls or texts, that consent will be requested separately, and giving it is not a condition of purchasing any goods or services. You represent that you are the owner or authorized user of the telephone number and email address you submit.
6. License and Acceptable Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes. You agree not to:
- use the Site for any unlawful purpose or in violation of these Terms;
- copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Site without our prior written consent;
- access the Site using bots, scrapers, crawlers, or other automated means, except search-engine indexing we permit;
- attempt to gain unauthorized access to the Site, its administrative areas, servers, or related systems;
- interfere with or disrupt the operation, integrity, or security of the Site;
- upload or transmit any virus, malware, or other harmful code; or
- submit false, misleading, or fraudulent information, submit information about another person without authorization, or impersonate any person or entity.
7. Intellectual Property
The Site and its content, features, and functionality, including text, graphics, logos, images, and software, are owned by AccuGuard, its affiliates, or its licensors and are protected by United States and international intellectual property laws. “AccuGuard,” “The Mobile Lab,” and related names and logos are trademarks or service marks of AccuGuard or its affiliates. Nothing in these Terms grants you any right to use these marks without our prior written permission.
8. Third-Party Links and Services
The Site may contain links to third-party websites, social media pages, content, or services that we do not own or control. We provide these links for convenience only and are not responsible for their content or practices. Your use of them is at your own risk and subject to their terms.
9. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT. ANY WARRANTIES FOR SERVICES ARE PROVIDED, IF AT ALL, ONLY BY THE LOCAL OFFICE THAT PERFORMS THE SERVICES.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCUGUARD AND ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, OR TO ANY SERVICES PROVIDED BY A LOCAL OFFICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless AccuGuard and its affiliates and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site, your submission of false or unauthorized information, or your violation of these Terms or applicable law.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived by agreement.
13. Changes to the Site and These Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may revise these Terms from time to time. When we do, we will update the Effective Date above and post the revised Terms on the Site. Your continued use of the Site after revised Terms are posted constitutes your acceptance of them.
14. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and AccuGuard regarding the Site. If any provision is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent.
